Abstract
The norm for children protection in the case of premarital dispensation in a religion court has not allegedly given a protection for children. The indication was seen in the disharmony of children protection norm between the act number 23/2002 concerning Children Protection and the act number 1/1974 concerning Marriage in the case of marital dispensation, so that it has not met the goal of law protection. The disharmony of those acts caused the different perception in the excecution which created the law uncertainty, the ineffective and inefficient implementation of law, and the dysfuntion of law. Therefore, it needs the reconstruction of norm for children protection in the case of marital dispensation in religion court.
