Abstract

The purpose of this research is to find out the legal protection of children as perpetratorsof the crime of theft through the diversion system in the juvenile criminal justice system. The research method used in this research is normative juridical research derived from the literature and court decisions. The results of the study indicate that legal protection of children as perpetrators of the crime of theft through diversion in the juvenile criminal justice system is the transfer of settlement of children's cases from the criminal justice process to a process outside of a fair criminal justice with an emphasis on restoring back to its original state, and not retaliation. In addition, through diversion, children as perpetrators of the crime of theft are given punishment with an educational aspect in order to provide justice and legal protection to children without ignoring the child's criminal responsibility in a non-formal way. Based on this description, it can be said that diversion is not a peaceful effort between a child who commits a crime of theft and the victim or his family, but a form of punishment for children in conflict with the law
